1. These terms are an agreement between you and us.

  1. All transactions on the website uppbod.com are subject to the terms set forth herein, and these terms apply to your visit to the website and any transactions you may have, now or later, through the site.
  2. By using the website, the user agrees to abide by these terms. Those who use the services of the site confirm that they have read and accept these terms. Usage includes viewing, gathering information, and/or utilizing any services offered on uppbod.com as they appear to users at any given time. All usage of the website is limited to actions that are considered reasonable and lawful, along with the information and services offered at each time.
  3. We have divided our terms into two sections: these user terms and separate seller terms. User terms apply to those who want to create an account, bid, and/or purchase items on the website. Seller terms apply to those who want to auction and sell items on the site.

2. Definitions

Website: Refers to both the domain uppbod.com and its responsible party, Daggir Solutions ehf., ID number 6905090670.

Item: Means the item, movable property, vehicle, real estate, or other objects offered on the website by a seller.

Seller: Legal entity or individual who creates and lists items on the website, either in auctions they create or that are already offered on the site.

User: Party who has created an account on the website and thereby agrees to these user terms. User also means buyer and seller.

Seller Owner: The owner of the item intended to be sold at auction, who may be the seller themselves.

Buyer: The party who, by placing a bid, has agreed to both these user terms and the buyer-specific terms, and holds the highest valid bid on the item being auctioned.

Expert: The seller or their representative, appointed by the seller, who can approve or reject items submitted by users for review before being listed on the site.

Seller Commission: The fee the seller pays when selling an item.

Buyer Protection: Auction and service fees added on top of the sale price of an item, paid by the user.

Fees: Refers to both buyer protection and seller commission combined or separately.

3. Website Services

  1. The website is an automated auction platform. We connect sellers with buyers through a fully digital auction market.
  2. We are intermediaries, not the sellers. The website is not a traditional auction house. We do not own the items listed or sold on the website and do not directly participate in communication between buyers and sellers. The website intermediates sales between buyers and sellers and ensures both parties fulfill their obligations under the site's terms.

4. Items on Auction

  1. Items listed may vary greatly. Sellers or their experts manage the sale of their own items or items on behalf of others.
  2. Sellers usually post an appraisal with the item, but in some cases no appraisal is available. It is the user's responsibility to gather sufficient information to assess the value of the item before bidding or buying. Items with a minimum reserve price are marked as such until a bid reaches at least the reserve price.
  3. Users who place bids on items with a reserve are bound by their bid amount, but the seller is not obligated to sell unless the reserve is met. Sellers have 48 hours after the auction closes to approve the highest valid bid. Once a user's bid is accepted, whether reserve was met or not, fees according to these terms or applicable laws are added.
  4. Items listed without a minimum reserve are sold to the highest bidder. The seller is obligated to complete the sale at that price plus any applicable fees.
  5. The item's description will include delivery options and associated costs. Sellers can offer delivery or require pick-up by the buyer. Delivery costs must be clearly stated in the item description so users can consider them before bidding. Special rules or charges may apply to certain items, and these will be listed in the item's description.
  6. Some items may be subject to laws or regulations, such as those concerning alcohol, weapons including antiques, restricted goods, or protected cultural artifacts. Sellers are responsible for compliance with applicable laws.
  7. Special note: Many auction items may be old, fragile, used, or handmade. Users are strongly encouraged to carefully read item descriptions before bidding.

5. User Access

  1. To use the service, Daggir collects user information, such as national ID, address, phone number, and email, via electronic ID or email login.
  2. Users are responsible for keeping their passwords secure. By providing their email, users consent to receiving necessary service-related emails.
  3. Usernames, passwords, and contact information are considered access information. Access rights are personal and may not be transferred to another individual or entity.
  4. Users must only access and use the service legally.
  5. If a user suspects unauthorized access, they must immediately notify us at [email protected].
  6. Access may be disrupted for various reasons, e.g., hardware failure, software issues, or upgrades. The website is not liable for any resulting damages.
  7. Users agree not to use any automated software or method to access, copy, or monitor the website without written permission.
  8. Users agree not to upload viruses, worms, or harmful files, or disrupt normal website functionality.
  9. Users may not attempt to retrieve or analyze the website's underlying software code. If they encounter it due to a malfunction, they must notify us.

6. Participation in Auctions

  1. Users must create an account and provide their national ID, address, and payment details to bid. Some auctions require electronic ID verification or a background check.
  2. Items without bids start at a minimum bid price and follow minimum bid increments until the auction closes.
  3. Users can bid by either directly placing a bid at least equal to the required increment or setting a maximum bid where the system bids automatically up to that amount.
  4. If two users set the same maximum bid, the earliest one takes precedence.
  5. Once confirmed, bids are binding even if the bid is not the highest or does not meet the reserve price.
  6. Bids cannot be altered or withdrawn.
  7. Minimum price means the lowest price a seller commits to sell the item for.
  8. Auctions end at a scheduled time, but no item auction ends earlier than 3 minutes after the last bid.
  9. If an item does not meet its reserve, the seller may still accept the highest bid.
  10. Bidders commit to paying the highest bid plus applicable fees such as buyer protection and copyright fees.
  11. Appraisals provided are for reference only; users are encouraged to seek independent valuations. Investment purchases are entirely the user’s responsibility.
  12. Product descriptions are created by sellers. All items are sold as described and as pictured. Colors and shadows may vary in photos. Condition reports may be available. Attention: Most items are used and are sold in described condition. If a description is seriously deficient, see article 10 of these terms.

7. User Obligations

  1. By bidding on an item, the user enters into a business relationship with the seller if they hold the highest valid bid. This relationship carries the same meaning as a formal contract for the sale and purchase of the item. These user terms and seller terms, along with the seller’s item description and the user's bid, govern this contract.
  2. When a user holds the highest valid bid at auction close, payment for the highest bid amount plus applicable fees is automatically charged to the user’s registered payment method.
  3. If the payment method fails to authorize the amount, the user has 48 hours to update payment details and complete the transaction via the website. If no payment is made within 48 hours, the website reserves the right to offer the item to the next highest bidder. The non-paying user must pay a 20% penalty fee based on their highest bid, plus all applicable fees, which are charged to their registered payment method or invoiced with added collection costs.
  4. Buyer Protection covers auction and administrative fees according to the current Fee Schedule. It includes due diligence on sellers, reliability checks on listed items, and safekeeping of payment until delivery is confirmed. Buyer Protection is added on top of the highest bid and is payable by the user. The user commits to paying this fee once notified that they hold the highest valid bid, regardless of whether the sale is completed.
  5. Other applicable fees, such as copyright fees on artworks and delivery costs, are also charged.
  6. Breaches of these purchase obligations can result in collections, temporary or permanent suspension of the user’s account.

8. Delivery of Items

  1. Upon payment, the buyer becomes the owner and the seller is notified via the website and/or email.
  2. Delivery instructions are provided, depending on whether the item is shipped or picked up.
  3. Buyers are responsible for ensuring the provided address is correct and for notifying Uppbod.com about any changes required to fulfill the purchase.
  4. Uppbod.com handles communication to facilitate delivery between the buyer and seller as needed via email or other communications.
  5. If shipping costs are paid by the buyer, these are final unless unforeseen costs arise, such as storage fees or government-imposed charges. Such additional fees are the responsibility of the buyer. The seller is responsible for delivering the item, whether shipped or collected.
  6. If delivery is delayed beyond 10 days without a response from the seller, the buyer should contact support at [email protected] for assistance.
  7. If issues arise that cannot be reasonably resolved, the website may cancel the sale and refund the buyer.

9. Receipt of Items

  1. Once the buyer receives the item, they must mark it as Received through their account.
  2. If the buyer has any comments regarding the item’s condition or description, they must immediately mark the item as Received with remarks and provide a detailed description of the concerns.
  3. If a seller marks an item as delivered and the buyer does not confirm or raise a concern within 3 days, the purchase is deemed finalized and the website’s role as intermediary ends.
  4. Buyers and sellers are encouraged to leave feedback for each other to help the community.

10. Buyer Comments and Returns

  1. Buyers have 3 days after notification of delivery to raise concerns.
  2. After 3 days, the seller receives payment, and refund requests through the website are no longer possible.
  3. After the 3-day period, the buyer must contact the seller directly to resolve any issues. If the item’s description was seriously inaccurate, the buyer can mark the item accordingly and the website will assist in resolving the dispute, which may include repair, exchange, price reduction, or cancellation of the sale at the seller’s expense.
  4. New products sold by companies have a statutory return period.
  5. Used goods returns must comply with the applicable laws at the time.
  6. For private sales, returns depend on agreement between parties, but fees paid to the website are non-refundable.
  7. Returned items must be delivered back to the seller at the buyer’s expense unless otherwise agreed. The buyer remains responsible for the item during return shipping.
  8. Users who falsely request returns or refunds despite sellers fulfilling all obligations may face legal action, and the website and sellers reserve the right to report such abuse to authorities.
  9. If a seller does not have permission to list and sell an item, they are fully responsible to buyers under these terms. The website will assist in resolving such cases as best as possible.

11. Special Seller Terms

  1. In some cases, sellers may have additional specific terms listed in item descriptions, which users can view before bidding. Such terms are an addition to the general terms of the website but only if they don't violate general terms. In the case where there is a conflict in the website's general terms and Special Seller Terms the Special Seller Terms shall prevail.

12. Messages and Notifications

  1. The website sends notifications to users regarding account creation, winning bids, being outbid, tracked items nearing auction end, and other necessary updates.
  2. Occasional notifications unrelated to transactions may also be sent.
  3. Users can manage their notification preferences except for mandatory notifications related to transactions.
  4. Notifications are not encrypted and will not include passwords.
  5. Forgotten passwords are reset via a secure link sent to the user’s registered email. Notification delays or errors may occur.
  6. The website does not guarantee timely or accurate delivery of notifications and bears no liability for related decisions or damages.

13. Privacy

  1. Registration requires users to provide personal data such as name, national ID, address, email, and account details.
  2. Daggir Solutions ehf. operates in accordance with Icelandic Privacy Act No. 90/2018. The site’s policy is to minimize the use of personal data to what is necessary to provide the service. User data is never sold, leased, or disclosed to third parties unless legally required or in case of company acquisition or merger.

14. Intellectual Property

  1. All website content, including design, software, editorial content, notifications, and other materials, are protected by copyright and trademark laws. Content is either owned by the website or licensed for use. Users may only download or print content for personal, non-commercial use as permitted under the Copyright Act. Redistribution, republication, or electronic reproduction is prohibited without written permission from Daggir Solutions ehf.
  2. Content uploaded by users such as photos or descriptions grants the website a free, unlimited license to use the material, for example in marketing.

15. User Account Termination

  1. The website reserves the right to take necessary action in response to breaches of these terms, including immediate account closure.
  2. We may unilaterally suspend or delete accounts at any time without notice. Users will be informed via email if action is taken. Examples include abuse, violations of terms, or behavior that shows an unwillingness or inability to comply with the terms. Suspected legal violations may be reported to authorities.
  3. Personal data is retained for 30 days after account closure and then deleted per our Privacy Policy.

16. Term and Changes to Terms

  1. The website may amend these user terms or seller terms at any time. Changes take effect immediately unless they are unfavorable to users, in which case at least 7 days' notice will be given.

17. Limitation of Liability

  1. The website is not liable for inconvenience or damages arising from equipment or software failures, user actions, or external factors such as natural disasters, war, strikes, or force majeure. We are not liable for losses due to misunderstandings, misuse, or technical issues.

18. Dispute Resolution and Jurisdiction

  1. These terms are governed by Icelandic law. If any provision is deemed invalid, it does not affect the validity of other terms. Even if we do not exercise certain rights, that does not mean we waive them. Any disputes arising from these terms must be brought before the Reykjavik District Court.
